Article 74: The President exercises the powers of summoning, prorogation, and dissolution on the aid and advice of the Council of Ministers headed by the Prime Minister.

Adjournment Sine Die vs. Prorogation
| Feature | Adjournment Sine Die | Prorogation |
| Meaning | Terminates a particular sitting of the House indefinitely without naming a day for reassembly. | Terminates both the sitting and the entire session of the House. |
| Authority | Presiding Officer (Speaker in Lok Sabha / Chairman in Rajya Sabha). | President of India (acting on Cabinet advice). |
| Status of Bills | Does not affect pending bills or business. | Does not cause pending bills to lapse. Notices of motions/resolutions lapse unless renewed. |
| Reconvening | The Presiding Officer can recall the sitting without issuing fresh summons. | A new session requires a formal presidential order and fresh summons. |
Why the Time Gap Matters (The Issue Raised)
Convention vs. Discretion: In standard parliamentary practice (Kaul & Shakdher), the Cabinet recommends prorogation within 2 to 4 days after the Presiding Officer adjourns the House sine die.
Implications of Non-Prorogation: Until the President formally prorogues the House, the current session technically remains alive.
The Speaker can re-convene a sitting under short notice without waiting for fresh presidential summons.
